La actora suscribi\u00f3 una reserva por la compra de un inmueble, entregando U$S 1.000, suma que fue aceptada por la vendedora. En dicho instrumento se estableci\u00f3 que la operaci\u00f3n quedaba condicionada a que la reservante obtuviera un cr\u00e9dito bancario dentro del plazo de 40 d\u00edas; y se estableci\u00f3 tambi\u00e9n que, a partir de la obtenci\u00f3n del cr\u00e9dito, la reserva adquirir\u00eda el car\u00e1cter de se\u00f1a. Posteriormente, la actora entreg\u00f3 a la inmobiliaria interviniente U$S 14.000 como refuerzo de la reserva inicial, acto que no fue conformado por la vendedora. El cr\u00e9dito bancario fue obtenido por la oferente dentro del plazo establecido, pero la operaci\u00f3n se frustr\u00f3, restituy\u00e9ndose a la reservante la suma de U$S 15.000. La pretensi\u00f3n central esgrimida por la actora es que, trat\u00e1ndose de una se\u00f1a, corresponde la aplicaci\u00f3n del art. 1059 CCCN, por lo que las sumas oportunamente entregadas debieron restitu\u00edrsele dobladas. El tribunal acoge parcialmente la demanda. Consider\u00f3 que la reserva inicial de U$S 1.000 se convirti\u00f3 en se\u00f1a al cumplirse la condici\u00f3n (obtenci\u00f3n del cr\u00e9dito) y conden\u00f3 a la demandada a devolver dicha suma doblada, con m\u00e1s sus intereses.
